Wedding Videography Agreement

1. Entire agreement
This agreement contains the entire understanding between Brawner Digital and the undersigned clients. It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is in writing, signed by all relevant parties.
2. Reservation and deposit
Upon signature, Brawner Digital will reserve the date and time above and will not accept other bookings for that date. A non-refundable deposit of $120 (10% of the total) is due at the time of signing. The deposit is applied toward the contracted package. The remaining balance of $1,075 is due on or before the wedding date. No videos will be distributed until the balance is paid in full.
3. Cancellation
If the client cancels contracted services before the ceremony takes place, the deposit is forfeited. Brawner Digital agrees to refund all additional paid amounts less any documented expenditures. The deposit is non-refundable even in the event of date changes, postponements, acts of God, fire, strike, or extreme weather.
4. Delivery
Following the wedding, Brawner Digital will deliver finished video files via a private Dropbox link, YouTube, or Vimeo. Standard processing time is 4–8 weeks from the wedding date. The client may download or share files at any time.
5. Pre-event consultation
The parties agree to a pre-event consultation to finalize shooting times, locations, and shot priorities. This may be conducted by phone or email. The client agrees to share any finalized wedding-day timeline with Brawner Digital no later than two weeks before the event.
6. Event guide and cooperation
At larger events, the client is responsible for designating someone to identify individuals and objects for which specific video is desired. Brawner Digital will not be held accountable for missed footage of persons not identified during the event. Both parties agree to positive cooperation and communication for the best possible result.
7. Coverage schedule
Videography commences at the scheduled start time above. Should any portion of the event begin late for any reason, Brawner Digital will not be liable for footage not captured during the delay. The bride and groom agree to set aside up to 60 minutes — either before or after the ceremony — for group video that cannot be obtained during the ceremony or reception.
8. House rules and venue guidelines
The videographer is subject to guidelines set by the ceremony official or reception site management. The client agrees to accept the technical results of any restrictions imposed. Negotiation with venue officials for moderation of guidelines is the client's responsibility; Brawner Digital will offer technical recommendations only.
8a. Drone footage — airspace and regulatory notice
The selected package includes drone footage (if applicable). Brawner Digital operates all drone equipment in compliance with FAA regulations and applicable local laws. However, the client acknowledges and accepts that drone footage cannot be guaranteed. Conditions that may prevent drone operation include, but are not limited to: restricted or controlled airspace, temporary flight restrictions (TFRs), venue prohibitions, local ordinances, adverse weather, and proximity to airports, hospitals, or other protected areas. In the event that drone footage cannot be obtained due to any of the above, no partial refund will be issued for the drone component of the package, as all other contracted services will be delivered in full. Brawner Digital will make every reasonable effort to secure airspace approval in advance and will notify the client as early as possible if drone coverage is not feasible.
9. Exclusivity and guest conduct
Brawner Digital serves as the sole and exclusive videographer. Guests are welcome to photograph and video with their own devices, provided they do not interfere with Brawner Digital's work. The client is responsible for the conduct of their guests. Unchecked interference that materially degrades video quality, or physical damage to equipment, may result in immediate departure of the videographer with no refund granted.
10. Copyright and usage rights
All videos produced by Brawner Digital are protected by copyright law. The client is granted personal usage rights for reproduction and distribution to friends and family. Written permission from and compensation to Brawner Digital is required before the client, or any third party, publishes or sells the videos for profit. Brawner Digital retains the right to use footage for portfolio, advertising, website, and promotional purposes unless a written opt-out is provided prior to signing.
11. Limit of liability
In the event of severe medical, natural, or other emergencies preventing performance, Brawner Digital will make every effort to secure a qualified replacement videographer at the same or similar rate. If no suitable replacement is found, liability is limited to the return of all payments received. In the unlikely event of video loss, theft, or destruction for any reason, liability is similarly limited to the return of all payments received for the event package.
12. Right of withdrawal
Brawner Digital may withdraw from this agreement if discovery of new information, changes in circumstances, non-cooperation, missed appointments, or late payments compromise the integrity of the engagement. Should Brawner Digital initiate withdrawal, all fees will be returned minus $100/hr for videography services already rendered and $100/hr for consultations and driving time, rounded to the nearest half-hour.
13. Payment methods
Payment may be made by cash, bank transfer, PayPal, Venmo, Visa, Mastercard, or American Express. A payment schedule will be confirmed via email following contract acceptance.
14. Severability and amendments
If any provision of this agreement is held invalid or unenforceable, the remaining provisions shall remain in full force. Any amendments must be in writing and signed by both parties.
