This agreement contains the entire understanding between Brawner Digital and the undersigned client. It supersedes all prior and simultaneous agreements between the parties. Any changes must be made in writing and signed by both parties.
Upon signature, Brawner Digital will reserve the agreed session date. A non-refundable deposit of $100 (10% of the total) is due at the time of signing and applied toward the package. The remaining balance of $895 is due before or on the session date. No finished film will be delivered until the balance is paid in full.
We understand that health and family circumstances can change unexpectedly. Cancellations made more than 7 days before the session will forfeit the deposit only. If a cancellation is made after the filming session has been completed, 50% of the total contract price is forfeited to cover time, editing preparation, and resources already committed. For packages that include two filming sessions, cancellation of the second session after the first has been filmed will result in a refund of $495 only — equivalent to the additional filming session add-on price — with no further refund obligation. Rescheduling with more than 72 hours' notice is complimentary once; subsequent reschedules may incur a $75 rescheduling fee. If the subject is unwell or unable to participate on the day, we will reschedule at no charge.
Brawner Digital will conduct all sessions with patience, sensitivity, and respect. We will never press a subject on topics they are unwilling to discuss. The client acknowledges that the subject's comfort takes priority over the filming schedule, and that Brawner Digital may adjust or shorten the session based on the subject's wellbeing, without penalty or refund obligation beyond the policies stated in clause 3.
The finished film will be delivered digitally (via private download link) within 4–8 weeks of the session. Physical media (USB, DVD) where included will be mailed to the client's address within one week of digital delivery. Raw footage, where included in the package or purchased as an add-on, will be delivered digitally within 24 hours of the session.
All footage produced by Brawner Digital is protected by copyright law. The client is granted full personal usage rights — including sharing with family, printing stills, and archiving the film. Written permission is required before the film or any portion is published commercially or submitted to festivals or competitions. Brawner Digital must obtain the client's explicit written consent before publicly publishing, sharing on social media, or using any short clips from the film for portfolio, promotional, or any other public-facing purposes. The client may withhold or revoke this consent at any time in writing.
In the unlikely event of equipment failure, data loss, or circumstances beyond Brawner Digital's control that prevent delivery of a completed film, liability is limited to the return of all payments received. Brawner Digital uses professional-grade equipment and maintains redundant backup systems at all times.
Brawner Digital treats all personal stories, family information, and footage shared during the course of this project as strictly confidential. Nothing will be shared publicly without the client's explicit written consent. The client confirms they have the permission of the subject (or are the legal guardian of the subject) to commission this film.
Payment may be made by cash, bank transfer, PayPal, Venmo, Visa, Mastercard, or American Express.
If any provision of this agreement is held invalid, the remaining provisions remain in full force. Amendments must be in writing and signed by both parties.
